General Terms and Conditions

1 Scope of application

These General Terms and Conditions (GTC) govern the contractual relationship between:

jolicaillou SA, operator of the website www.diams.com

and

any person making a purchase through the online shop of the website www.diams.com.

Any order implies full and unconditional acceptance of these General Terms and Conditions.

The customer may save or print these terms and conditions.

2 Products

The products offered for sale are those presented on the website www.diams.com.

Each product is accompanied by a description detailing its essential characteristics.

Photographs and representations of the products are provided for illustrative purposes only.

3 Natural characteristics of stones

Diamonds, pearls and colored gemstones are natural products.

They may present:

• slight variations in color

• natural inclusions

• differences in proportions or structure

These characteristics are part of the nature of gemstones and cannot be considered defects.

4 Certificates 

Certain diamonds are accompanied by a certificate issued by an independent laboratory, notably the GIA (Gemological Institute of America).

These certificates represent a scientific opinion based on the laboratory’s analytical methods and do not constitute a contractual guarantee from jolicaillou SA.

5 Prices

Prices are indicated in the currency selected by the customer.

They are valid at the time of the order.

Delivery costs are offered for deliveries within Switzerland.

Full payment of the price is required at the time of the order.

6 Order

The order is validated when the customer confirms the shopping cart and proceeds with payment.

The validation system constitutes an electronic signature with the same legal value as a handwritten signature.

An order confirmation is sent by email.

7 Verification and fraud prevention

In certain cases, diams.com reserves the right to request additional information in order to verify the identity of the buyer or the validity of the payment.

In the event of suspected fraud or insufficient information, the order may be suspended or cancelled.

8 Payment

Payment may be made using the payment methods offered during the order process.

The customer guarantees that they have the necessary authorizations to use the chosen payment method.

In the event of refusal of payment authorization, the order will be cancelled.

9 Product availability

Offers are valid while stocks last.

In the event that a product becomes unavailable after an order, the customer will be informed as soon as possible.

The customer may choose between:

• a refund

• replacement of the product

10 Manufacturing and variations

The jewelry offered may be produced or adjusted by specialized workshops.

Slight variations may occur regarding:

• total weight

• dimensions

• proportions

Such variations are normal in jewelry manufacturing.

11 Delivery

Products are delivered to the address indicated during the order.

Shipments are carried out via secure and insured transport.

The responsibility of diams.com ends when the parcel is delivered to the recipient against signature.

12 Right of return

The customer has a period of 30 days from delivery to return a product that does not suit them.

The product must be returned:

• in its original condition

• accompanied by its certificate

• in its complete packaging

Return costs are borne by the customer.

The following orders are not eligible for return:

• loose diamonds ordered without mounting

• custom creations

• personalized jewelry

13 Warranty

Jewelry sold by jolicaillou SA is covered by a two-year warranty against manufacturing defects.

The warranty does not cover:

• normal wear

• scratches

• deformation due to use

• damage resulting from accident or misuse

14 Authenticity of diamonds

Unless otherwise stated, the diamonds offered by diams.com are natural diamonds.

The diamonds comply with the Kimberley Process, an international agreement aimed at preventing the trade of conflict diamonds.

15 Confidentiality

Personal information collected during orders is processed in accordance with Swiss data protection legislation.

This information is used solely for the purpose of processing orders.

16 Force majeure

The liability of diams.com cannot be engaged if the execution of the contract is prevented by an event of force majeure.

17 Partial validity

If one clause of these terms and conditions is declared invalid, the remaining provisions shall remain applicable.

18 Applicable law and jurisdictio

These general terms and conditions are governed by Swiss law.

In the event of a dispute, the parties will seek an amicable solution.

Failing this, the place of jurisdiction shall be Lausanne, Switzerland.
